These Terms and Conditions govern the use of our website, products, services, promotional offers, website development services, hosting services, domain services, and related digital solutions provided by DIGITAL AND ARTIFICIAL INTELLIGENCE MARKETING HUB (DAIM HUB FIJI).

By purchasing our services, accepting a quotation, paying an invoice, or using our website, you agree to these Terms and Conditions.

2. Promotional Website Specials

All promotional website packages, including limited-time offers, are subject to availability and may be modified, extended, or withdrawn by DAIM HUB at any time without prior notice.

Once a quotation is approved, the promotional pricing is reserved for seven (7) days.

Failure to make payment within seven (7) days may result in the promotional offer being cancelled and standard pricing being applied.

3. Project Process

The project process is as follows:

  1. Client submits all required content and information.
  2. DAIM HUB reviews and approves the supplied materials.
  3. Invoice is issued.
  4. Full payment is required.
  5. Project commences.

No work will begin until all required content and full payment have been received.

4. Payment Terms

All promotional website packages require 100% upfront payment.

Payments are non-refundable as digital products and services including domains, hosting, software licenses, website essentials, and development resources are purchased immediately upon project commencement.

Failure to make payment within seven (7) days of invoice issuance may result in additional charges.

5. Late Payment Charges

Invoices must be paid within seven (7) days from the invoice date.

A late payment surcharge of fifteen percent (15%) shall apply for every additional seven (7) day period that the invoice remains unpaid.

Example:

  • 7 days overdue: 15% surcharge.
  • 14 days overdue: additional 15% surcharge.
  • 21 days overdue: additional 15% surcharge.

After three (3) payment delays, DAIM HUB reserves the right to:

  • Cancel the quotation.
  • Withdraw all promotional pricing.
  • Refuse future services.
  • Place the client on an internal service blacklist.
  • Require future projects to be quoted at standard pricing.

No work shall commence until payment obligations are fully satisfied.

6. Project Timeframes

Initial website drafts or first designs are generally delivered within fifteen (15) to thirty (30) working days after:

  • Full payment has been received.
  • Content has been approved.
  • All required information has been supplied.

Project timelines may be extended due to client delays.

7. Client Responsibilities

Clients are responsible for providing:

  • Text content.
  • Images.
  • Logos.
  • Product information.
  • Service information.
  • Company details.
  • Contact information.
  • Any required documentation.

DAIM HUB is not responsible for delays caused by incomplete information.

8. Logo Design

Where required, DAIM HUB may provide a standard logo or branding package.

Three (3) revisions are included.

Additional revisions are charged at FJD $50 per revision.

9. Website Revisions

Website packages include three (3) revisions.

Additional revisions are charged at FJD $50 per revision.

Major redesigns, structural changes, additional features, or significant changes are considered additional work.

10. Additional Work

The following services are not included in promotional packages:

  • Additional pages.
  • New features.
  • Additional functionality.
  • Major redesigns.
  • Additional integrations.
  • E-commerce additions.
  • Custom development.

Additional pages are charged at FJD $50 per page.

Additional services are quoted separately.

11. Client Inactivity

Clients are expected to respond to requests for information, approvals, and revisions in a timely manner.

If a client fails to respond within fourteen (14) days during the revision process, the project may be suspended.

Projects inactive for more than thirty (30) days after delivery of the first revision may be considered abandoned.

Reactivation of suspended projects requires a FJD $150 project reinstatement fee.

11.1 Abandoned Projects

Projects that remain inactive for more than ninety (90) consecutive days due to client delays, lack of communication, failure to provide feedback, failure to provide requested materials, or failure to respond to DAIM HUB communications may be considered abandoned.

DAIM HUB reserves the right to:

  • Suspend the project indefinitely.
  • Archive or remove project files.
  • Delete temporary working files and development environments.
  • Release reserved project resources.
  • Close the project without refund.

If the client wishes to continue an abandoned project after ninety (90) days, DAIM HUB may:

  • Require a project reactivation fee.
  • Require updated pricing based on current service rates.
  • Require a new agreement or quotation.
  • Require additional development fees depending on the work required.

DAIM HUB shall not be responsible for the loss of project files, content, temporary backups, development versions, or other materials relating to abandoned projects.

12. Hosting Services

DAIM HUB provides shared hosting services under promotional packages.


Included:

  • Website hosting.
  • Website management.
  • Website administration access.

Not included:

  • cPanel access.
  • Hosting platform access.
  • Root access.

Website backend administrator access is provided where applicable.

FTP access may be granted at DAIM HUB’s discretion.

13. Domain Ownership

Domains and hosting services remain under DAIM HUB management until:

  • The project has been completed.
  • Applicable transfer fees have been paid.
  • The client requests a transfer.

Hosting and domain services are valid for one (1) year from the date of payment.

14. Website Transfer Services

Upon completion of the project, clients may choose to continue hosting with DAIM HUB or transfer their website and domain to another provider.


Option 1: Continue Hosting with DAIM HUB

Clients renewing directly with DAIM HUB shall pay:

  • FJD $500 annually for Domain Registration and Website Hosting.

No transfer fees apply.


Option 2: Client Purchases Their Own Hosting

If the client purchases their own domain and hosting services through another provider and requests DAIM HUB to transfer the website, a one-time website migration and transfer fee of FJD $350 shall apply.

Transfer services include:

  • Website files transfer.
  • Database migration.
  • Domain transfer assistance.
  • Website deployment.

Transfers shall only occur after:

  • Full project completion.
  • Full payment of all outstanding invoices.
  • Completion of all contractual obligations.

15. Website Backups

Monthly backups are included.


Optional services:

  • Weekly backups: FJD $150 annually.
  • Daily backups: FJD $250 annually.

16. Renewals

Renewal reminders may be sent:

  • 30 days before expiration.
  • 15 days before expiration.
  • 7 days before expiration.
  • 3 days before expiration.
  • 1 day before expiration.

Clients are responsible for renewing their services before expiration.

17. Expired Domains and Hosting

Failure to renew services before expiration may result in domain suspension, website downtime, or permanent deletion by third-party providers.

Expired services may require a restoration or recovery fee of FJD $650 plus any applicable third-party charges.

18. Cancellation and Termination Policy

Clients may request cancellation of services at any time.

If a client wishes to deactivate all services:

  • The website may be taken offline.
  • The domain shall remain under DAIM HUB management.
  • A website closure and administration fee of FJD $350 shall apply.

Early Contract Termination

If a client decides to transfer their website, domain, and hosting to a third-party provider before the twelve (12) month contract period expires, a FJD $650 early termination and transfer fee shall apply.

Transfer During Renewal Period

If the client decides to transfer services during the final thirty (30) days before renewal:

Between 30 and 15 Days Before Expiry
  • Renewal with DAIM HUB: FJD $350 for Domain and Hosting.
  • Third-party transfer: FJD $450 transfer fee.
Between 14 and 1 Day Before Expiry
  • Renewal with DAIM HUB: FJD $400 for Domain and Hosting.
  • Third-party transfer: FJD $550 transfer fee.

After Expiration

If the domain or hosting has expired and the client wishes to transfer services:

  • Domain and hosting restoration fee: FJD $650.
  • Third-party transfer fee: FJD $550.

Additional third-party registrar or hosting charges may apply.

19. Refund Policy

Refund requests may only be considered within twenty-four (24) hours of payment.

Once domains, hosting, software, or digital services have been purchased, no refunds are available.

20. Portfolio Rights

DAIM HUB reserves the right to:

  • Display completed projects.
  • Use project screenshots.
  • Showcase websites in portfolios.
  • Promote completed work on social media and marketing materials.

21. Acceptable Use Policy

Clients may not use DAIM HUB services for:

  • Illegal activities.
  • Fraud.
  • Copyright infringement.
  • Spam.
  • Pirated software.
  • Hate speech.
  • Malware distribution.
  • Scam activities.
  • Adult content.
  • Gambling.
  • Unlawful business activities.

DAIM HUB reserves the right to report unlawful activities to the appropriate authorities.

22. Third-Party Services

DAIM HUB relies on third-party providers including:

  • Domain registrars.
  • Hosting providers.
  • Software vendors.
  • Payment processors.
  • Search engines.
  • Social media platforms.

DAIM HUB is not responsible for third-party outages, service interruptions, or policy changes.

23. SEO and Marketing Services Disclaimer

The One-Page Scroll Website Special includes basic technical and on-page SEO setup only.

This may include:

  • Meta titles.
  • Meta descriptions.
  • Basic heading structure.
  • Image optimization.
  • Technical SEO setup.
  • Search engine visibility settings.
  • Sitemap configuration.

The promotional package does not include:

  • Professional SEO campaigns.
  • Search engine ranking services.
  • Google Ads management.
  • Facebook advertising.
  • Social media management.
  • Content marketing.
  • Google ranking optimization.
  • Lead generation campaigns.
  • Digital marketing campaigns.

Additional marketing services may be purchased separately after project completion and shall be subject to separate quotations, service agreements, terms, and pricing.

DAIM HUB does not guarantee:

  • Search engine rankings.
  • First-page Google rankings.
  • Sales.
  • Leads.
  • Revenue increases.
  • Social media growth.
  • Advertising results.

Marketing results depend on numerous external factors beyond DAIM HUB’s control.

24. Website Security

While reasonable security measures are implemented, no website can be guaranteed to be completely secure.

Clients are responsible for maintaining secure passwords and account access.

25. Limitation of Liability

DAIM HUB’s maximum liability shall not exceed the amount paid by the client for the services provided, less any third-party costs including domains, hosting, software, licenses, and related digital services.


DAIM HUB shall not be liable for:

  • Loss of profits.
  • Business interruption.
  • Data loss.
  • Loss of sales.
  • Indirect damages.
  • Consequential damages.

26. Indemnification

Clients agree to indemnify and hold harmless DAIM HUB against any claims, damages, legal costs, or liabilities arising from:

  • Client content.
  • Client business activities.
  • Copyright violations.
  • Illegal activities.
  • Misuse of services.

27. Force Majeure

DAIM HUB shall not be responsible for delays or failures caused by events outside reasonable control.

28. Dispute Resolution

The parties agree to attempt mediation before commencing legal proceedings.

Any disputes shall be governed by the laws of the Republic of Fiji.

The courts of Fiji shall have exclusive jurisdiction.

29. Governing Law

These Terms and Conditions are governed by the laws of the Republic of Fiji.

30. Changes to These Terms

DAIM HUB reserves the right to update these Terms and Conditions at any time.

Updated versions will be published on this website.

Continued use of our services constitutes acceptance of the updated Terms.

32. Right to Refuse Service

DAIM HUB reserves the right to refuse, suspend, terminate, or decline services to any individual, business, organization, or client at its sole discretion.

Reasons may include, but are not limited to:

  • Abusive or threatening behavior.
  • Repeated payment delays.
  • Unreasonable demands.
  • Violation of these Terms and Conditions.
  • Illegal or prohibited activities.
  • Misrepresentation or fraudulent information.
  • Harassment of DAIM HUB staff or representatives.

Where applicable, outstanding fees, transfer fees, restoration fees, and contractual obligations shall remain payable.

DAIM HUB reserves the right to decline future services to any former client.
