These terms are intended to provide a strong commercial framework, but no website terms can remove rights or liabilities that applicable law says cannot be excluded. Project-specific written terms remain essential for material engagements.
1. Acceptance of these Terms
These Website Terms of Use apply to your access to and use of daimhub.com and any DAIM HUB webpage, form, downloadable material or online feature that links to these Terms. By using the website, you agree to these Terms. If you do not agree, do not use the website.
These Terms govern website use only. Any paid or professional service supplied by DAIM HUB is also subject to the DAIM HUB Service Terms & Conditions and, most importantly, the project-specific quotation, proposal, statement of work, service order, written confirmation or contract agreed for that particular engagement.
2. Information, enquiries and no automatic engagement
Website content, indicative pricing, service descriptions, examples and consultation information are provided for general information and business development purposes. They are not a binding offer, guarantee, warranty or promise that DAIM HUB will accept a particular project, meet a particular price, achieve a particular result or deliver within a particular timeframe.
Submitting a contact form, service enquiry, file or request does not create a client relationship, agency, partnership, fiduciary relationship or binding service contract. A service engagement begins only when DAIM HUB confirms the engagement in writing under agreed project or case-specific terms.
3. Permitted use
You may use the website for lawful personal or business purposes, including reviewing DAIM HUB services and sending genuine enquiries. You must not use the website in a manner that is unlawful, fraudulent, abusive, misleading, harmful, defamatory, infringing, disruptive or intended to compromise another person, system or network.
- Do not submit false identities, fabricated project details, fraudulent payment evidence or misleading authority to act for another person or organisation.
- Do not upload malware, malicious code, stolen data, unlawful content, confidential information you are not authorised to disclose, or material that infringes third-party rights.
- Do not attempt unauthorised access, credential attacks, vulnerability exploitation, denial-of-service activity, security bypassing or interference with website infrastructure.
- Do not scrape, crawl, copy or automate access in a way that circumvents technical controls, creates unreasonable load, harvests personal information or interferes with legitimate use. Normal search-engine indexing is not prohibited.
- Do not use DAIM HUB branding, content, contact details or identity to impersonate DAIM HUB or mislead another person.
4. Security, fraud and verification
DAIM HUB may use reasonable anti-spam, anti-fraud, identity, authority, ownership and security checks before responding to or acting on an enquiry. DAIM HUB may decline, pause or terminate communications where activity appears fraudulent, unlawful, unauthorised, abusive or unsafe.
Never rely on an unexpected change to payment or bank details without independently verifying it through a known DAIM HUB contact method. DAIM HUB may require verbal or written verification before sensitive account, domain, hosting, system, network or payment instructions are actioned. To the fullest extent permitted by law, DAIM HUB is not responsible for loss caused by third-party impersonation, phishing or compromise outside DAIM HUB’s reasonable control where reasonable verification procedures were not followed.
5. Intellectual property
Unless otherwise stated, the website design, DAIM HUB name and branding, graphics, copy, service descriptions, code, templates, demonstrations and other original website material are owned by or licensed to DAIM HUB. No ownership is transferred merely because content is publicly accessible.
You may view and print reasonable extracts for internal evaluation. You may not reproduce, resell, republish, distribute, create misleading derivatives from, remove rights notices from, or commercially exploit DAIM HUB material without written permission, except where applicable law expressly permits it.
6. User submissions
You retain ownership of material you submit. You confirm that you have authority and all necessary rights to provide it to DAIM HUB. You grant DAIM HUB a limited permission to store, copy, review, transmit and otherwise process the material as reasonably necessary to assess your enquiry, communicate with you, provide an agreed service, maintain records, protect systems and comply with law.
Do not submit passwords, secret keys, recovery codes, banking credentials or other highly sensitive access information through a general website form. DAIM HUB may provide or agree a more appropriate secure method where credentials are genuinely required for a project.
7. External services and links
The website may link to or rely on third-party platforms, hosting providers, social networks, maps, communication tools, plugins, payment services, cloud providers or other external services. DAIM HUB does not control those third parties and is not responsible for their independent content, policies, availability, security, pricing or actions. Your use of a third-party service may be subject to that provider’s separate terms.
8. Availability and changes
DAIM HUB may change, suspend, restrict or discontinue any part of the website without notice. While reasonable care is taken, DAIM HUB does not promise that the website will be uninterrupted, error-free, fully secure, free of harmful components or continuously available on every browser, device, network or location.
9. Disclaimer and limitation of liability
The website is provided on an “as available” basis. To the fullest extent permitted by law, DAIM HUB excludes warranties and liability that are not expressly stated in a written project-specific agreement. DAIM HUB will not be liable for indirect, incidental, special, consequential or purely economic loss arising solely from website use, inability to use the website, reliance on general website content, third-party services or unauthorised use outside DAIM HUB’s reasonable control.
Nothing in these Terms excludes, restricts or modifies any right, remedy, guarantee or liability that cannot lawfully be excluded, restricted or modified under applicable law.
10. Indemnity for unlawful use
To the fullest extent permitted by law, you are responsible for and agree to indemnify DAIM HUB against third-party claims, losses and reasonable costs arising from your unlawful or fraudulent website use, your infringement of another person’s rights, material you submit without authority, or your material breach of these Terms. This clause does not require you to indemnify DAIM HUB for loss caused by DAIM HUB’s own unlawful conduct to the extent liability cannot lawfully be excluded.
11. Governing law and disputes
These Terms are governed by the laws of the Republic of Fiji. Subject to any mandatory rights or forum that cannot lawfully be excluded, disputes relating to these Terms or use of the website are subject to the jurisdiction of the courts of Fiji.
Before commencing non-urgent court proceedings, the parties should attempt in good faith to resolve the issue through direct discussion. Nothing prevents either party from seeking urgent protective or injunctive relief where appropriate.
12. Changes and contact
DAIM HUB may update these Terms from time to time. The version displayed on the website applies from its stated effective date. Continued website use after an update constitutes acceptance of the updated website-use terms to the extent permitted by law.
Questions about these Terms can be sent to info@daimhub.com.
DAIM HUB’s final scope, responsibilities, fees, risk allocation and special conditions are confirmed for each project or case before the engagement begins.
